  4. Liability and Indemnity: Participants agree, in accordance with applicable laws, to indemnify and hold harmless Lofty Surfaces, its affiliates, officers, agents, and employees from any claim arising out of their participation in any promotion, referral program, or the use of discounts.
  5. Severability: If any part of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
  6. Discounts and Promotions: Discounts and promotions cannot be combined unless expressly stated. Lofty Surfaces reserves the right to revoke a promotion or discount at any time.
  7. Force Majeure: Lofty Surfaces will not be liable for failure to perform its obligations if such failure is as a result of Acts of God (including natural disasters), war, terrorism, strikes, epidemics, pandemics, safety hazard of Asbestos-Containing Materials or Lead, or any other events outside our reasonable control.
  8. Service Area: Lofty Surfaces' service area may be geographically restricted. Additional fees may apply for services outside the standard area, and such fees will be disclosed prior to service engagement.
  9. Agreement to Terms: By participating in any promotion, referral program, or using discounts provided by Lofty Surfaces, customers agree to these Terms and Conditions.
  10. Dispute Resolution: Any disputes will be handled individually and exclusively through binding arbitration or in an appropriate court within the jurisdiction of Massachusetts.
  11. Promotional Periods: Each promotional or referral offer will be available for a limited time, with details specified in the offer's terms.
  12. Cumulative Rights: The rights and remedies under these Terms and Conditions are cumulative and do not exclude rights provided by law.
